The briefing

The Consumer Legislation Amendment Bill 2026 rewrites large parts of the Estate Agents Act 1980 and the Sale of Land Act 1962. Diana Bevacqua of ApexHR takes the whole team through what changes, when it lands, and what to have ready before each date below.

9th September 2026Licence suspension for late trust account audits (ss 24E–24G) and the narrower off-the-plan rescission right for apartment buyers (s 9AEA) both commence on this date, the day after Royal Assent.
1st October 2026The whole property price statement and seller’s reserve price regime. This is a fixed date, not a proclamation.
By 1st June 2027Section 32 statements move to a “sale availability time” model, ready 14 days before auction, not on signing day.
By 1st July 2027Deposits locked until settlement unless the contract says otherwise; commission comes from the vendor, not the deposit.
By 1st December 2027Mandatory reporting of sale data to Consumer Affairs Victoria.

Price transparency

The statement of information becomes the property price statement: key features, comparables and, once you have it, the seller’s reserve. The reserve must publish for 7 clear days before you can run the auction at all.

Section 32 timing

The obligation shifts from “give before signing” to “make available” from the sale availability time. For a standard auction, that’s 14 days before the first auction date. For a private sale, it must be available 14 days from when the property is first advertised.

s 26A · 26B

Deposits & commission

New section 26A locks the deposit down until settlement. New section 26B moves commission out of the deposit entirely. It comes from the vendor instead.

s 24E–24G

Trust accounts & reporting

Licence suspension for late trust account audits will be live from 9th September 2026. Mandatory sale-data reporting to CAV follows by 1st December 2027.

Immediately: check trust account audit lodgement. The suspension power will be in effect from 9th September 2026.

Before 1st October 2026: we’re currently awaiting Consumer Affairs Victoria to release the Property Price Statement template. Once it’s available, we’ll build out the guidance and templates and try to have them ready by 1st October (note: there is a 14 day grace period, given how little time the legislation changes leave us). We’ll provide more details and information as it becomes available.
